Trademark Registration
The registration procedure before the Benelux IP Office (BOIP) is one of the fastest within Europe. The trademark application is first examined on formalities and absolute grounds and subsequently the application is published. There is a two months opposition period within which proprietors of prior similar marks can object to registration of the trademark application. If no opposition has been filed the registration certificate is issued.
A registration procedure without any objections will be finalized within 3-4 months.
It is also possible to request for an expedited registration procedure in Benelux. A provisional registration certificate will then be issued within 1-2 days if the application meets the formal grounds. In this case the examination on absolute grounds and publication for opposition purposes will take place afterwards. This procedure is used when e.g. the proprietor of the mark wishes to start a court action based on a trademark registration.
